1. Acceptance of Terms
By downloading, accessing, or using the Escriblo application (the "App"), operated by Tres Orígenes EAS ("we," "us," or "our"), you agree to be bound by these Terms and Conditions (the "Terms") and by ourPrivacy Policy. If you do not agree, do not use the App.
We may modify these Terms at any time. We will notify you by posting the updated version and changing the "Last updated" date. Continued use of the App after such changes constitutes your acceptance of the new Terms.
2. User Accounts
To use the App you must create an account and be of legal age under the laws of your country. You agree to:
- Provide accurate, current, and complete information when registering.
- Keep your account information up to date.
- Protect the confidentiality of your password and accept the risk of any unauthorized access to your account.
- Notify us immediately if you detect any unauthorized use or security breach related to your account.
You are responsible for all activity that occurs under your account. We may suspend or terminate your account if the information provided proves to be false or misleading.
3. Use of the App
Escriblo is a space to save, organize, and relive memories — quotes, moments, photos, and audio — individually or shared. You agree to use the App only for its intended purposes and in accordance with the law.
You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Upload content that is illegal, defamatory, infringes third-party rights, or that you are not authorized to share.
- Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
- Interfere with the integrity or performance of the App.
- Transmit viruses or other malicious code, or reverse engineer the software.
- Share your access credentials with third parties.
4. Your Content
You retain ownership of all content you create or upload to the App (your memories, text, photos, and audio; your "Content"). You grant us a limited, worldwide, royalty-free license to host, store, reproduce, and display your Content solely to operate and provide the Services, including syncing it across your devices and making it available to the other members of a shared book.
You are solely responsible for your Content and for having the rights and permissions necessary to store and share it, including information about other people.
5. Shared Books
You may invite others to collaborate on a book. By doing so, you authorize the members of that book to access the Content it contains and, depending on their role, to modify it. You are responsible for whom you invite.Tres Orígenes EAS is not responsible for how other members use the Content of a shared book.
6. Plans and Payments
The App may offer both free and paid features. Where applicable, purchases and subscriptions are handled and billed through the Apple App Store or Google Play, subject to their terms. Renewal, cancellation, and refunds are governed by the policies of the relevant store.
7. Intellectual Property
The App and all of its content and functionality (excluding your Content), including the software, design, logos, text, and graphics, are the property of Tres Orígenes EAS or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or sell any part of the App without our written permission.
8. Disclaimers
THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN BACKUPS OF ANY CONTENT YOU CONSIDER IMPORTANT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRES ORÍGENES EAS, ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR CONTENT, ARISING FROM THE USE OF OR INABILITY TO USE THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to defend and indemnify Tres Orígenes EAS and its team against any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your Content, or your breach of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time if you breach these Terms. You may cancel your account at any time by ceasing to use the App or deleting it from the settings. Provisions that by their nature should survive termination will remain in effect.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Paraguay, without regard to its conflict-of-law rules. Any dispute will be submitted to the competent courts of Asunción, Paraguay.
13. General Provisions
If any provision of these Terms is held invalid, the remaining provisions will remain in effect. These Terms and the Privacy Policy constitute the entire agreement between you and Tres Orígenes EAS regarding the App.
